A few key points

1) Dividends, interest, and services each use a different test

Even within investment/labor income, the source test varies. Dividends follow "the paying corporation's nationality," interest follows "where the payer is," and personal services follow "where the services were actually performed." A U.S. company's dividend is U.S.-source; pay for work done in the U.S. is U.S.-source. This distinction ultimately drives which country taxes first and where the credit is given.

2) Attributed to a PE means sourced there

Paragraph (8) states an important general rule: if a resident of one country has a permanent establishment in the other, and income is effectively connected with that PE, the income is sourced where the PE is. So with a business foothold, items like dividends or interest can be pulled in as PE income.

3) Not covered → each country's law; conflict → mutual agreement

Paragraph (9) says income not caught by the above is sourced under each country's own law, and if the two countries disagree or the source is unclear, the competent authorities may set a common source to prevent double taxation.

A taxpayer-friendly principle: Some treaty source rules differ from the U.S. Internal Revenue Code. But because Article 4 says the treaty won't increase U.S. tax, the IRS explanation states a taxpayer isn't required to apply the treaty's source rules when computing U.S. liability. If domestic law is more favorable, you may use it.
