앞 편에서 사적 연금(제23조)은 "받는 사람이 사는 나라"에서 과세한다고 했습니다. 그런데 공적 연금인 미국 Social Security(SS)나 한국 국민연금은 원칙이 정반대입니다. 이를 정하는 조항이 제24조 "사회보장급여(Social Security Payments)"입니다.

핵심 원칙 — "지급하는 나라에서만 과세"

제24조는 이렇게 정합니다. 한쪽 나라가 상대국 거주자에게 지급하는 사회보장급여 및 기타 공적 연금(예: 철도퇴직연금 등)은, 그 급여를 지급하는 나라(원천지국)에서만 과세됩니다. 사적 연금이 "거주지국 과세"인 것과 달리, 사회보장급여는 "지급국 과세"가 원칙입니다.

한국이 미국 시민·거주자에게 주는 경우 — 명시적 면세

IRS 설명서는 특히 한국이 지급하는 사회보장급여를 미국 시민 또는 거주자가 받는 경우, 그 급여는 미국에서 면세된다고 명시합니다(즉 한국에서만 과세). 예컨대 미국에 사는 분이 한국 국민연금을 받는다면, 그 연금은 미국 세금 신고에서 과세되지 않고 한국 과세 대상이 되는 것이 원칙입니다. 은퇴 후 한국 국민연금을 받는 재미교포에게 실질적으로 중요한 포인트입니다.

미국 SS를 한국에서 받는 경우

반대로 미국 Social Security를 한국 거주자가 받으면, 조약상 지급국인 미국에서만 과세됩니다. 참고로 미국 국내법상 비거주 외국인에게 지급되는 SS는 일정 방식으로 원천징수·과세되는데, 조약의 "지급국 과세" 원칙이 이와 같은 방향입니다. 구체적 세율·원천징수·순액 계산은 미국 국내 절차를 별도로 확인해야 합니다.

정부용역(제22조)은 이 조항이 아니다

주의할 점 하나. 정부의 공무 수행에 대한 급여·연금(제22조 정부용역)은 제24조에 포함되지 않습니다. 공무원 연금 등은 제22조에서 별도로 판단되니, "공적 연금"이라고 다 제24조로 묶지 않도록 조심해야 합니다.

Last time we saw that private pensions (Article 23) are taxed by "the country the recipient lives in." But for public pensions — U.S. Social Security (SS) or Korea's National Pension — the rule is the opposite. That's set by Article 24, "Social Security Payments."

This post was checked directly against the IRS Technical Explanation.

The core rule — "taxed only by the paying country"

Article 24 provides that social security payments and other public pensions (e.g., railroad retirement benefits) paid by one country to a resident of the other are taxable only in the paying (source) country. Unlike private pensions (residence-country taxation), social security uses "paying-country taxation."

When Korea pays a U.S. citizen/resident — an explicit exemption

The IRS explanation specifically states that when social security payments made by Korea are received by a U.S. citizen or resident, those payments are exempt from U.S. tax (i.e., taxable only in Korea). So if you live in the U.S. and receive Korea's National Pension, that pension is generally not taxed on your U.S. return and is taxed by Korea instead. A practically important point for Korean-Americans drawing Korea's National Pension in retirement.

When you receive U.S. SS in Korea

Conversely, if a Korean resident receives U.S. Social Security, the treaty makes it taxable only in the paying country, the U.S. Note that U.S. domestic law taxes/withholds SS paid to nonresident aliens in a particular way, consistent with the treaty's "paying-country" direction. Confirm exact rates, withholding, and net calculations under the separate U.S. domestic procedures.

Government service (Article 22) is NOT covered here

One caution: pay and pensions for governmental service (Article 22) are not included in Article 24. Civil-service pensions and the like are judged separately under Article 22, so don't lump all "public pensions" into Article 24.

Important — "dual social security taxes" is a different issue. Article 24 only addresses taxation of the benefits you receive. The problem of paying social security taxes (FICA / National Pension) to both countries while working is solved not by this tax treaty but by the separate U.S.–Korea Totalization Agreement (effective April 1, 2001).
